I didn't know it was illegal in some cases..but, regardless, I wouldn't do it, anyway. I agree..it's not kind!
(have to add, though...if I saw a nest in harm's way, I would move it...gently)

We usually just wait until the babies are out of the nest and able to build their own (elsewhere preferably). I'm so tired of the birds behind the shutters.
We also have a robin who yearly builds a nest under our deck. Then she screams at me when I go outside to water my garden.

We don't move the nests but they are not in high traffic areas. We use alternate routes if we have to.

I remember my family just getting rid of nets, as they were built in the worse places.
